For decades, the home buying process followed a familiar pattern. Sellers hired a listing agent and agreed to pay a commission. That commission was often shared with the agent who brought the buyer. The Multiple Listing Service (MLS) displayed these commission offers, making buyer representation accessible and straightforward.

What Changed and Why

Following a 2023 legal settlement involving the National Association of REALTORS®, the industry adopted new practices starting August 17, 2024. The main difference is that commission sharing can no longer be advertised through the MLS. This shift brought several practical changes for buyers.

You are now responsible for establishing your own relationship with a buyer's agent. Written agreements between you and your agent are required before touring homes together. While sellers may still contribute toward your agent's compensation, this arrangement must be negotiated during the offer process rather than assumed from the start.

Oregon took additional steps with House Bill 4058, effective January 1, 2025. This law requires formal buyer representation agreements before an agent can assist you with residential property searches or purchases. According to the Oregon Real Estate Agency, these agreements must clearly state whether they are exclusive or nonexclusive, outline the agent's legal obligations, describe how compensation works, and include termination rights for both parties.
